Information for the data subject (applicant) in the case of direct collection (Art. 13 GDPR)

Your personal application data will be processed in accordance with the General Data Protection Regulation and the country-specific data protection regulations applicable to the Solenix Group (hereinafter “the group"). For this purpose, the group has implemented numerous technical and organizational measures to ensure the protection of your applicant data.

Your documents have been received by Solenix Engineering GmbH (hereinafter "Solenix"), a company of the group. Based on internal group agreements, Solenix carries out the application processes for and on behalf of the entire Solenix group.

As part of our application process and due to the close cooperation between the individual companies of the group, we intend to transfer your data within the group. With regard to the processing of your personal data in Switzerland, we would like to point out that the European Commission has confirmed in a decision that there is an adequate level of data protection in Switzerland.

What type of data do we process?

For our application process we need and process the following personal data:

  • name and surname
  • postal address
  • phone number
  • email address
  • certificates and qualifications
  • CV
  • short profile
  • skills matrix

Data transfer to partners

An essential part of the business activities of the group is the cooperation with other companies and customers within the framework of projects, which may also involve the assignment of our employees to these companies and customers.

The projects are regularly put out to tender, in which the respective company of the group has to prove, among other things, that suitable and qualified personnel are available.

For this purpose, Solenix might need to transmit the above-mentioned data to a narrow circle of contact persons of its (potential) partner companies and customers (hereinafter jointly “contractual partners”).

A transmission takes place exclusively to contractual partners who are based in a member state of the European Union or in a country for which the European Commission has confirmed an adequate level of data protection.

The purpose of the transmission is to determine whether a company of the group can be commissioned by the relevant contractual partner to establish an employment relationship between a company of the group and you.

During the recruitment process Solenix will inform you if your personal data needs to be transferred to a contractual partner. The transmission takes place on the basis of an agreement with the respective contractual partner or company, according to which they are obliged to delete the transmitted personal data if it is decided not to proceed with your application.

For what purposes is the processing of your personal data necessary and what are the legal bases?

We process the personal data sent with your application in order to check your suitability for a position, or any other vacant positions in our company, and to carry out the application process. Your personal data is processed on the legal basis of Art. 88 GDPR in conjunction with Section 26 (1) BDSG (new). According to this, the processing of your personal data is permitted, which is necessary in the course of making a decision on the establishment of an employment relationship.

Storage beyond the current application process or disclosure to third parties constitutes consent in accordance with Article 6 Paragraph 1 lit. a GDPR, which meets the requirements for consent in accordance with Article 7 Paragraphs 1-4 GDPR fulfilled, ahead.

Who receives your data?

Internal recipients have access to your application. These are: the recruitment team, hiring managers, executive management, and IT administrators.

As mentioned above, it may be that in the preparation of business proposals Solenix needs to forward your data to its customers.

How long do we keep your data?

If your application is followed by the conclusion of a contract, your data must be stored and used for the purpose of the usual organizational and administrative process, in compliance with the relevant legal regulations.

In the event that your application is unsuccessful and no employment contract for the position for which you have applied is concluded with Solenix, Solenix will store your aforementioned personal data (electronic and printed) in an applicant database for a period up to 6 months.

The purpose of storing your personal data is to enable Solenix to contact you based on your professional profile in the event of future vacancies. If a future vacancy fits your professional profile, Solenix may contact you to inquire about your interest in the available position.

There is no obligation on your part to express your interest or to participate in the application process for future vacant positions.

Your personal data is subject to the access rights of the employees responsible for recruitment at Solenix while it is being stored. Solenix employees who are not involved in the application and hiring process do not have access to your personal data.

Should you not agree to this, you can withdraw your consent anytime by contacting us and ask for your information to be removed from the database.

Provision of personal data and consequence of non-provision:

Applicants must provide the relevant personal data for an application process. The lack of necessary personal data means that an application cannot be considered or that employment is not possible.

Automated decision-making: 

There is no automated decision-making or profiling.

Right to complain to a supervisory authority

You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us. Right of withdrawal

You are entitled to revoke this consent in accordance with Art. 7 Para. 3 DSGVO at any time and without giving reasons. In the event of a revocation, Solenix will no longer transmit your personal data to its contractual partners. However, any processing of your personal data carried out until the revocation remains lawful.

Voluntary declaration

You are not obliged to agree to this declaration of consent. If you are rejected, you will not suffer any disadvantages during the application process at Solenix. However, Solenix cannot offer you any positions that would have arisen because of a contractor's interest in your profile.
